Terms of service

OVERVIEW
Welcome to Maison Caelune! The terms "we", "us" and "our" refer to Maison Caelune. Maison Caelune operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Maison Caelune is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - OUR PRODUCTS
We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.
We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted or rendered in our online stores.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.

SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Maison Caelune reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Maison Caelune confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as Maison Caelune may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy [LINK].
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.
Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.

SECTION 5 - SHIPPING AND DELIVERY
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

SECTION 5 - SHIPPING, DELIVERY AND FULFILLMENT

All shipping, processing, handling, fulfillment, transit, and delivery dates communicated by Maison Caelune are estimates unless expressly identified in writing as guaranteed. Processing time and transit time are separate periods, and an estimated delivery date does not constitute a guarantee that an order will arrive on or before that date.

Maison Caelune may use its own facilities, third-party fulfillment centers, manufacturers, distributors, suppliers, logistics providers, warehouses, freight companies, postal services, couriers, or other third parties in connection with the processing and delivery of orders.

Shipping or fulfillment may be affected by inventory discrepancies, warehouse processing, carrier delays, supplier delays, customs, weather conditions, transportation interruptions, system errors, payment verification, fraud screening, address verification, high order volume, labor disruptions, governmental action, force majeure events, or other circumstances.

Nothing in this Section eliminates any right or remedy that cannot lawfully be waived under applicable law.

SECTION 5A - ORDER REVIEW, SECURITY SCREENING AND RIGHT TO DECLINE FULFILLMENT

Maison Caelune reserves the right, to the fullest extent permitted by applicable law, to review, hold, investigate, reject, cancel, limit, or decline to fulfill any order before shipment.

An order may be placed under review or declined for reasons including, without limitation:

(a) suspected fraud;

(b) suspected unauthorized use of a payment method;

(c) an elevated risk of chargeback or payment reversal;

(d) inconsistencies between billing information, shipping information, account information, IP information, payment information, or other order information;

(e) previous chargebacks, refunds, payment disputes, delivery disputes, or suspected abuse associated with the customer, payment method, address, account, device, or transaction;

(f) unusual ordering activity;

(g) unusually high-value purchases;

(h) unusually large quantities;

(i) multiple orders placed within a short period;

(j) use of freight-forwarding, reshipping, package-forwarding, or similar services;

(k) inability to verify payment authorization;

(l) inability to reasonably verify the customer's identity, shipping address, billing information, or other information associated with the transaction;

(m) suspected resale, unauthorized commercial purchasing, or export activity;

(n) suspected misuse of discounts, promotions, refund policies, return policies, or promotional codes;

(o) inconsistent communications concerning the order;

(p) suspected attempts to obtain merchandise without payment;

(q) suspected false claims concerning previous orders;

(r) suspected return, refund, replacement, delivery, or chargeback abuse;

(s) inventory, supplier, pricing, technical, or fulfillment concerns;

(t) safety or security concerns;

(u) violation or suspected violation of these Terms; or

(v) any other legitimate business, security, fraud-prevention, payment-risk, inventory, operational, or compliance consideration.

Maison Caelune is not required to ship an order merely because a payment authorization has occurred, an order number has been generated, or an automated order confirmation has been transmitted.

Where permitted by law, Maison Caelune may make fulfillment and cancellation decisions based upon good-faith risk assessments, including circumstances where Maison Caelune reasonably believes that completing the transaction could expose Maison Caelune to fraud, an illegitimate refund request, an unauthorized payment dispute, a dishonest chargeback, loss of merchandise, payment reversal, or other financial or operational harm.

SECTION 5B - INTERNAL RISK INFORMATION AND REASONS FOR ORDER CANCELLATION

Maison Caelune may maintain confidential internal procedures, criteria, security controls, fraud-detection systems, transaction-risk assessments, payment-risk indicators, customer-risk indicators, and other methods used to evaluate orders.

Except where disclosure is required by applicable law, Maison Caelune is not obligated to disclose:

(a) its internal fraud-detection criteria;

(b) internal risk scores;

(c) specific security indicators;

(d) methods used to identify potentially fraudulent transactions;

(e) information supplied by payment processors or fraud-prevention providers;

(f) internal loss-prevention procedures;

(g) specific factors that caused an order to be identified as high risk; or

(h) any information that Maison Caelune reasonably believes could allow a person to circumvent its security, fraud-prevention, payment, or loss-prevention systems.

Accordingly, Maison Caelune may cancel or decline an order without providing the customer with the complete internal reasoning, evidence, methodology, or risk analysis underlying that decision.

Where required by applicable law, Maison Caelune will provide any required cancellation, delay, refund, or other legally mandated notice.

No decision under this Section will knowingly be based upon a legally protected characteristic or any other consideration prohibited by applicable law.

SECTION 5C - PAYMENT AND IDENTITY VERIFICATION

Maison Caelune may require additional information before an order is fulfilled.

This may include reasonable verification of:

(a) customer identity;

(b) billing information;

(c) shipping information;

(d) ownership or authorization of a payment method;

(e) contact information;

(f) order details; or

(g) other information reasonably necessary to assess the legitimacy of the transaction.

Where reasonably necessary and permitted by law, Maison Caelune may request additional documentation.

A customer's failure or refusal to provide requested verification may result in the order being delayed, held, limited, or cancelled.

The fact that a customer's bank or payment provider authorized a transaction does not independently require Maison Caelune to accept or fulfill the order.

SECTION 5D - FULFILLMENT, WAREHOUSE AND PROCESSING ERRORS

Although Maison Caelune and its fulfillment partners use reasonable processes to fulfill orders accurately, errors may occasionally occur.

Such errors may include, without limitation:

(a) an incorrect item being shipped;

(b) an incorrect variation, finish, size, color, quantity, model, or configuration being shipped;

(c) a product being shipped to an incorrect address due to inaccurate information;

(d) duplicate shipments;

(e) omitted items;

(f) incomplete shipments;

(g) incorrect warehouse labels;

(h) incorrect inventory assignments;

(i) mismatched product identifiers or SKU information;

(j) warehouse scanning errors;

(k) supplier errors;

(l) packaging errors;

(m) fulfillment-center errors;

(n) inventory synchronization errors;

(o) software or integration errors;

(p) automated processing errors;

(q) carrier-label errors;

(r) order-routing errors;

(s) human error; or

(t) other unintended operational errors.

The occurrence of a fulfillment or shipping error does not, by itself, constitute fraud, intentional misconduct, bad faith, gross negligence, deceptive conduct, or a willful refusal by Maison Caelune to perform its obligations.

Maison Caelune will address confirmed fulfillment errors in accordance with these Terms, the applicable Refund Policy, and applicable law.

SECTION 5E - INCORRECT OR UNINTENDED MERCHANDISE

If a customer receives merchandise different from the merchandise shown in their confirmed order, the customer should notify Maison Caelune within a reasonable period after discovering the issue.

Maison Caelune may request reasonable evidence necessary to investigate the claim, including photographs of:

(a) the product received;

(b) outer packaging;

(c) shipping labels;

(d) product labels;

(e) serial numbers;

(f) model numbers;

(g) SKU information;

(h) packaging contents; or

(i) visible damage or discrepancies.

Maison Caelune may investigate the fulfillment history, shipping records, warehouse records, product weights, package dimensions, carrier information, photographs, scanning information, inventory information, and other available evidence relating to the shipment.

Where an incorrect shipment is confirmed, Maison Caelune may, subject to applicable law and its Refund Policy, correct the issue through one or more of the following:

(a) shipment of the correct merchandise;

(b) replacement of the merchandise;

(c) refund of the affected merchandise;

(d) partial refund where appropriate;

(e) prepaid return arrangements;

(f) exchange;

(g) store credit where voluntarily accepted by the customer; or

(h) another reasonable remedy permitted by law.

An accidental shipment of an incorrect item does not automatically entitle the customer to consequential damages, lost profits, reimbursement for unrelated expenditures, compensation for inconvenience, or any remedy beyond those required by applicable law.

Except where applicable law provides otherwise, a customer may not obtain duplicative recovery by retaining replacement merchandise, receiving a refund for the same merchandise, and obtaining additional compensation for the identical loss.

SECTION 5F - DUPLICATE AND ACCIDENTAL SHIPMENTS

A customer may occasionally receive more merchandise than ordered because of a warehouse, supplier, automation, carrier, inventory, or processing error.

Any rights or obligations concerning merchandise delivered by mistake will be governed by applicable law.

Maison Caelune may contact the customer concerning an accidental duplicate shipment and, where legally permitted, may provide reasonable instructions concerning its return.

Maison Caelune will not require a customer to bear return-shipping expenses where applicable law requires Maison Caelune to bear those expenses.

An accidental duplicate shipment does not create a continuing obligation for Maison Caelune to provide additional products, discounts, refunds, or compensation.

SECTION 5G - INVENTORY AND AVAILABILITY ERRORS

Product availability displayed through the Services may depend upon information obtained from suppliers, fulfillment partners, inventory-management systems, manufacturers, distributors, applications, integrations, or third-party databases.

Inventory information may occasionally be inaccurate, delayed, duplicated, corrupted, or out of date.

Maison Caelune therefore does not guarantee that a product shown as available will remain available until fulfillment occurs.

Maison Caelune may cancel or modify an order if:

(a) inventory becomes unavailable;

(b) a supplier is unable to provide the merchandise;

(c) an inventory discrepancy is discovered;

(d) a product has been discontinued;

(e) the product cannot reasonably be obtained;

(f) an incorrect product variation was displayed;

(g) a pricing or listing error occurred;

(h) a supplier materially changes the product before fulfillment; or

(i) another fulfillment problem prevents Maison Caelune from completing the order as expected.

Any cancellation, delay, or refund will be handled subject to applicable law.

SECTION 5H - SHIPPING DELAYS AND BACKORDERS

Shipment and delivery dates are estimates unless expressly stated otherwise.

Where Maison Caelune becomes unable to ship merchandise within a promised shipping period, Maison Caelune may provide a revised shipping estimate, request the customer's consent to a shipping delay, cancel the affected merchandise, or take another action permitted or required by applicable law.

Maison Caelune reserves the right to cancel an order rather than continue attempting fulfillment where Maison Caelune determines that fulfillment is unavailable, excessively delayed, commercially impracticable, unsafe, fraudulent, or otherwise inappropriate.

Nothing in these Terms authorizes Maison Caelune to retain payment for merchandise that Maison Caelune is legally required to refund.

SECTION 5I - SPLIT, PARTIAL AND MULTIPLE SHIPMENTS

Maison Caelune may fulfill an order through multiple warehouses, suppliers, manufacturers, logistics providers, or fulfillment partners.

Accordingly:

(a) products from the same order may arrive separately;

(b) separate tracking numbers may be generated;

(c) portions of an order may arrive on different dates;

(d) some items may ship while other items remain under processing;

(e) packaging may differ between shipments; and

(f) shipments may originate from different locations.

Receipt of only part of an order does not necessarily mean the remainder of the order was omitted.

Where Maison Caelune cannot ultimately fulfill an unshipped portion of an order, Maison Caelune will provide the remedy required by applicable law.

SECTION 5J - CUSTOMER SHIPPING INFORMATION

Customers are responsible for providing complete and accurate shipping information.

Maison Caelune is entitled to rely upon the shipping information submitted with the order unless Maison Caelune expressly accepts a later modification.

The customer is responsible for reviewing:

(a) recipient name;

(b) street address;

(c) apartment, suite, floor, or unit information;

(d) postal or ZIP code;

(e) city;

(f) state, province, or region;

(g) country;

(h) telephone number; and

(i) any delivery instructions supplied with the order.

Maison Caelune is not responsible, to the fullest extent permitted by applicable law, for delays, failed deliveries, additional charges, or losses caused by incorrect, incomplete, outdated, misleading, or inaccessible delivery information supplied by the customer.

Submitting an address-change request does not guarantee that the address can be changed after processing or fulfillment has begun.

SECTION 5K - ADDRESS CHANGES AFTER PURCHASE

Maison Caelune may refuse an address-change request after an order has entered processing.

This is particularly applicable where:

(a) a shipping label has already been generated;

(b) merchandise has already entered fulfillment;

(c) the order has been transmitted to a supplier;

(d) the carrier has possession of the merchandise;

(e) changing the address would materially increase fraud risk; or

(f) the requested address differs materially from the billing or originally verified information.

Maison Caelune may require cancellation and placement of a new order instead of altering an existing shipping address.

SECTION 5L - FREIGHT FORWARDERS AND THIRD-PARTY RECEIVERS

Where a customer voluntarily directs an order to a freight forwarder, package-forwarding service, reshipper, hotel, commercial mail-receiving agency, workplace, concierge, friend, family member, third-party warehouse, or other intermediary, Maison Caelune's responsibility may end to the fullest extent permitted by law after confirmed delivery to the address designated by the customer.

Maison Caelune is not responsible for subsequent loss, theft, damage, alteration, delay, repackaging, redirection, customs issues, or delivery failures caused by a third party after that third party takes possession of the shipment, except where applicable law provides otherwise.

SECTION 5M - DELIVERY CONFIRMATION AND PROOF OF DELIVERY

Maison Caelune may rely upon commercially reasonable carrier information when evaluating whether a shipment was delivered.

Such information may include:

(a) tracking scans;

(b) delivery photographs;

(c) carrier GPS information;

(d) electronic delivery records;

(e) signatures;

(f) timestamps;

(g) delivery-location information;

(h) building or concierge acceptance;

(i) postal records; and

(j) communications from the carrier.

A carrier's indication that a package was delivered may constitute evidence of delivery but will not eliminate any mandatory rights available to a customer under applicable law.

Maison Caelune may investigate a reported missing-delivery claim before issuing a refund or replacement.

SECTION 5N - LOST, STOLEN OR MISSING PACKAGES

Claims involving packages alleged to be lost, stolen, missing, misdelivered, or delivered but not received may be investigated by Maison Caelune and/or the applicable carrier.

Maison Caelune may request reasonable cooperation from the customer, including confirmation of the delivery address, review of delivery photographs, checking with household members, building staff or neighbors, or providing information reasonably required for a carrier investigation.

For high-value shipments, Maison Caelune may require additional investigation before approving a refund or replacement.

Nothing in this Section limits a customer's non-waivable rights under applicable law.

SECTION 5O - REFUSED, UNCLAIMED AND UNDELIVERABLE PACKAGES

If a package is:

(a) refused;

(b) unclaimed;

(c) returned because the address supplied was incorrect;

(d) returned because the recipient was unavailable;

(e) returned because required delivery attempts failed;

(f) returned because import duties or customs requirements were not completed;

(g) returned because access to the delivery location was unavailable; or

(h) otherwise returned to sender,

Maison Caelune may process the shipment in accordance with the Refund Policy and applicable law.

Where permitted by law, actual shipping, handling, carrier-return, customs, storage, or other nonrecoverable costs attributable to a customer's action or inaccurate information may be deducted from amounts otherwise refundable.

This Section does not apply to costs resulting solely from a confirmed Maison Caelune fulfillment error where applicable law requires Maison Caelune to bear such costs.

SECTION 5P - HIGH-VALUE ORDERS

Maison Caelune may impose additional security requirements for high-value merchandise or orders.

These requirements may include:

(a) signature confirmation;

(b) adult signature where legally appropriate;

(c) restricted delivery;

(d) identity verification;

(e) billing verification;

(f) additional processing time;

(g) carrier insurance;

(h) direct delivery requirements;

(i) prohibition of delivery to certain forwarding services; or

(j) cancellation where Maison Caelune cannot reasonably verify the transaction.

The customer agrees that these precautions are intended to reduce fraud, theft, unauthorized transactions, and delivery disputes.

SECTION 5Q - SIGNATURE REQUIREMENTS

Maison Caelune may require a signature for any shipment at its discretion.

If signature service is used, responsibility for ensuring that an authorized person is available to accept the shipment rests with the customer.

A signature obtained at the customer's designated delivery address may be considered evidence that the shipment was delivered to the requested location, subject to applicable law.

SECTION 5R - ORDER CANCELLATIONS AFTER PROCESSING

Requests to cancel an order are not guaranteed after an order has been accepted or entered fulfillment.

Automated processing may cause an order to proceed to fulfillment before customer service can review a cancellation request.

Maison Caelune is not responsible for an order being shipped after a cancellation request where the request was received after processing had progressed beyond the point at which cancellation could reasonably be completed.

If a shipment cannot be stopped, the customer's available options will be governed by the applicable Refund Policy and applicable law.

SECTION 5S - PAYMENT DISPUTES AND CHARGEBACKS

Maison Caelune reserves the right to investigate and respond to payment disputes, chargebacks, payment reversals, and claims submitted through banks, payment processors, card networks, financing providers, or other payment services.

Maison Caelune may provide transaction evidence to those entities, including where appropriate:

(a) order confirmations;

(b) payment records;

(c) communications;

(d) shipping information;

(e) tracking records;

(f) carrier confirmation;

(g) delivery photographs;

(h) signatures;

(i) account activity;

(j) IP, device, or transaction information lawfully maintained by Maison Caelune;

(k) refund-policy information;

(l) customer acknowledgments; and

(m) other evidence relevant to the dispute.

Maison Caelune reserves the right to challenge any chargeback or payment dispute that it reasonably believes is inaccurate, fraudulent, abusive, duplicative, misleading, or inconsistent with available transaction evidence.

Nothing in these Terms prevents a customer from exercising a chargeback, dispute, or consumer-protection right that applicable law gives the customer.

SECTION 5T - REFUND, RETURN AND CHARGEBACK ABUSE

Maison Caelune may restrict, decline, or cancel future transactions involving customers reasonably believed to have engaged in abuse of Maison Caelune's refund, return, replacement, shipping, promotional, or dispute processes.

Examples may include:

(a) repeated claims that delivered merchandise was not received;

(b) repeated claims of missing products inconsistent with available fulfillment records;

(c) materially inconsistent statements concerning an order;

(d) alteration or fabrication of evidence;

(e) returning a different item from the merchandise originally supplied;

(f) returning counterfeit or substituted merchandise;

(g) removing components before returning merchandise;

(h) intentionally damaging merchandise for purposes of obtaining compensation;

(i) attempting to receive both a refund and replacement for the same loss;

(j) filing a payment dispute after receiving an agreed refund;

(k) repeated unauthorized chargebacks;

(l) abuse of promotional offers;

(m) manipulation of shipping or delivery systems; or

(n) other conduct Maison Caelune reasonably believes constitutes fraud or abuse.

Maison Caelune may maintain reasonable records of such activity for legitimate fraud-prevention, security, legal, and operational purposes, subject to the Privacy Policy and applicable law.

SECTION 5U - PRODUCT PACKAGING AND PRESENTATION

Product packaging, protective materials, external cartons, internal packaging, labels, or supplier packaging may vary from photographs shown on the Services.

A variation in shipping or manufacturer packaging does not necessarily mean that the merchandise is incorrect, counterfeit, used, defective, or materially different from what was ordered.

Maison Caelune may use replacement, protective, generic, or additional packaging when reasonably necessary for transportation or fulfillment.

SECTION 5V - CARRIER AND THIRD-PARTY LOGISTICS EVENTS

Maison Caelune is not responsible, to the fullest extent permitted by applicable law, for circumstances caused solely by third-party carriers or logistics providers and outside Maison Caelune's reasonable control, including:

(a) carrier delays;

(b) carrier routing errors;

(c) transportation accidents;

(d) sorting errors;

(e) missed delivery scans;

(f) incorrect tracking updates;

(g) customs delays;

(h) customs inspections;

(i) weather disruptions;

(j) labor interruptions;

(k) transportation shutdowns;

(l) carrier equipment failures;

(m) regional emergencies;

(n) delivery-access restrictions;

(o) carrier network congestion; or

(p) other carrier-controlled circumstances.

Maison Caelune may, but is not always required to, assist the customer in communicating with or submitting claims to the applicable carrier.

SECTION 5W - CUSTOMS, DUTIES AND INTERNATIONAL ORDERS

International shipments may be subject to customs inspection, import requirements, taxes, duties, brokerage fees, documentation requirements, restrictions, or other governmental requirements.

Unless expressly stated otherwise, the customer is responsible for determining and satisfying applicable import requirements and for charges imposed by authorities or third parties that are legally the customer's responsibility.

Maison Caelune does not guarantee the duration of customs processing.

Maison Caelune may decline to ship to any jurisdiction, destination, forwarding service, or location presenting regulatory, logistical, sanctions, fraud, carrier, or operational concerns.

SECTION 5X - FORCE MAJEURE AND EVENTS OUTSIDE REASONABLE CONTROL

Maison Caelune will not be liable, to the fullest extent permitted by applicable law, for delay or failure caused by circumstances outside its reasonable control.

Such circumstances may include natural disasters, severe weather, fire, flood, earthquake, epidemic, pandemic, war, terrorism, civil disturbance, government action, sanctions, embargoes, customs interruptions, labor disputes, strikes, carrier disruptions, supply-chain interruptions, power failures, telecommunications failures, cyber incidents, third-party service outages, warehouse closures, transportation interruptions, shortages, or similar events.

Where such circumstances materially prevent fulfillment, Maison Caelune may delay, modify, or cancel affected orders subject to applicable law.

SECTION 5Y - LIMITATION OF SHIPPING AND FULFILLMENT LIABILITY

To the fullest extent permitted by applicable law, Maison Caelune will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from a shipping, fulfillment, delivery, inventory, warehouse, carrier, or processing error.

This may include, where legally permissible, loss of use, loss of opportunity, lost profits, lost business, lost income, installation expenses, contractor expenses, travel expenses, inconvenience, or other collateral costs that exceed the direct value of the affected transaction.

Where Maison Caelune is responsible for an incorrect shipment or other fulfillment error, Maison Caelune's obligation will be limited, to the fullest extent permitted by law, to providing an appropriate refund, replacement, exchange, correction, prepaid return arrangement where applicable, or other remedy required by law.

No provision of these Terms excludes liability that applicable law prohibits Maison Caelune from excluding.

SECTION 5Z - PRESERVATION OF LEGAL RIGHTS

The protections, limitations, rights, and remedies contained in this Section apply only to the fullest extent permitted by applicable law.

Nothing contained in these Terms is intended to:

(a) authorize Maison Caelune to retain payment for merchandise it has cancelled where a refund is legally required;

(b) eliminate legally required remedies for merchandise shipped incorrectly;

(c) eliminate mandatory consumer-protection rights;

(d) permit fraudulent, deceptive, unfair, or unlawful conduct;

(e) waive rights that cannot legally be waived; or

(f) prevent a customer from pursuing a remedy expressly provided by applicable law.

If any portion of this Section conflicts with a mandatory consumer-protection law, that law will control solely to the extent of the conflict, and the remaining provisions will continue in full force to the maximum extent permitted by law.

SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Maison Caelune, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws.

Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.

We are and shall be under no obligation (1) to maintain your Feedback in confidence; (2) to pay compensation for your Feedback; or (3) to respond to your Feedback.
